Objectives To review the extant literature on HIV criminal laws, and to determine the impact of these laws on public health practice.Methods The available research on this topic was obtained and reviewed.Results The extant literature addressed three main topics: people's awareness of HIV criminal laws; people's perceptions of HIV criminal laws; and the potential effects of HIV criminal laws on people's sexual, HIV-status disclosure and healthcare-seeking practices. Within these categories, the literature demonstrated a high level of awareness of HIV criminal (...) laws, but a poor comprehension of these laws. For perceptions, on the whole, the quantitative research identified support for, while the qualitative literature indicated opposition to, these laws. Lastly, the behavioural effects of HIV criminal laws appear to be complex and non-linear.Conclusions A review of the extant literature from a public health perspective leads to the conclusion that HIV criminal laws undermine public health. If the value of intrinsic value accounts lies in the establishment of an impetus to accept duties with respect to nature and to make sense of specific feelings of attachment and affection toward nature, then these goals can be met equally well through the virtue of compassion. Compassion is an other-directed emotion, and is thus not anthropocentric when directed toward nature. It requires us to be capable of relating to and identifying suffering in another. However, basing an ethic on compassion (...) requires a hermeneutic shift in how we think about nature and particular places such that we consider more closely how time is related to suffering. At the center of the following essay is an analysis of At the Mind's Limits by Jean Améry––philosopher and survivor of Auschwitz. The essay tries to define and refine, via comparison and contrast with works by Hannah Arendt and René Descartes, the unique conception of morality that arises from Améry's text. “Victim morality,” as it will be called here, is a non-normative morality which is patient and victim-based rather than agent or actor-based. It is grounded in a heightened exposure and (...) sensitivity to reality and suffering, which results from a reduction of a human being to “a bundle of reactions.” This process cannot be voluntarily undertaken but is violently undergone. Fundamental science is rapidly approaching its asymptote because it has been so successful. We already have a “theory of everything, that matters to the human race.” The laws of chemistry and physics cannot be replaced. Although most scientists react to this as though it were religious blasphemy, the proof is in our record. Since the discovery of quantum mechanics, no fundamental science of any significance to other sciences has appeared—in 70 years and with, perhaps, expenditures of$ 0.5 trillion. In contrast, (...) engineering and applied sciences have taken over the fundamental role, insofar as it is their advances from electric lights to cars, to planes, to computers that affect all science and all citizens. The reductionist model of approaching reality has been discredited. The most visible arena for the victory of the new integrationist approaches is in the reemergence of integrative medicine, which includes high-tech medicine in the larger body-mind-spirit, or whole person approach. Methodological divisions in sociology, the study of the social, are not just deep and persistent but patterned—most obviously in the separate development of qualitative methods in ethnography and grounded theory, but also in subsidiary divisions within those separations, following the same pattern. The pattern being too deep-rooted to be explained as empirical happenstance, it will be explored here as the effect of an equally deep-rooted condition. More exactly, through postulating that sociology’s subject-matter, the social, is ontologically rooted in an essential (...) ambiguity between abstraction and individuation. Four criteria are drawn from the idea of the dichotomy being constitutively essential, which this or any alternative candidates must meet. The article conducts the postulate through the criteria, and applies the criterion of separating better from worse sociological theory to the work of Pierre Bourdieu. (shrink)

In theories which contribute to the understanding of uncertainty in entrepreneurial action, scholars have traditionally attributed a negative connotation to uncertainty. This paper seeks to posit an understanding of uncertainty derived from Greek and Indian philosophy, where action of the human agent is not deterred by uncertainty, and rather, occurs despite uncertainty. This idea may be beneficial in making future entrepreneurs less apprehensive about uncertainty, by helping them locate the lessons from philosophy. I look at existing ideas that explore uncertainty (...) in entrepreneurial motivation, and present a multidisciplinary approach which sees uncertainty as a force that increases intent of action, rather than deterring it by drawing on the understanding of consequence and action in Aristotelean thought and Hindu philosophy, and extend the concepts of tuche and karma to posit a theoretical position which sees uncertainty as a factor that encourages entrepreneurial action and motivation. The understanding of uncertainty in management literature has been approached primarily from two disciplinary positions - economics and organisational theory. In economics, the classical understanding of uncertainty which commenced with Frank Knight’s Risk, Uncertainty and Profit (1921), was largely abandoned in later years for a more quantifiable approach of calculating risk. Uncertainty, characteristically nebulous and difficult to grapple with, is unquantifiable. It is defined, in fact, by Knight, as something which cannot be predicted and quantified. Thus, in academics, where almost all disciplines try to make sense of the way the world works, uncertainty has always been a problematic concept. (shrink)

The discussion of environmental aesthetics as it relates to ethics has primarily been concerned with how to harmonize aesthetic judgments of nature’s beauty with ecological judgments of nature’s health. This discussion brings to our attention the need for new perceptual norms for the experience of nature. Hence, focusing exclusively on the question of whether a work of “environmental art” is good or bad for the ecological health of a system occludes the important role such works can play in formulating new (...) perceptual norms and metaphors for nature. To illustrate this point, the work of sculptor Andy Goldsworthy presents us with a different perception of time that is ethically useful. (shrink)

This essay attempts to develop the foundations of what Val Plumwood calls a "dialogical ethical ontology." I defend Plumwood's analysis situating the conceptual roots of the environmental crisis in dualistic thinking, but disagree that a solution is arrived at in an intentional, teleological conception of nature. Rather than arguing for a substantial union of mind and nature, I argue that a relational ontology ought to be adopted. This analysis is carried out by examining three aspects of Plumwood's philosophy: the ascription (...) of "mind-like properties" to nature, her taking nature to be autonomous on the basis of that ascription, and the claim that sensitivity to place is necessary to the development of ethical dispositions toward nature. I conclude by presenting how her ethical views might be adjusted to accommodate the transition from a substantial ontology to a relational one. (shrink)

Andrew Feenberg’s critical theory of technology features a sophisticated analysis of the ways by which social forces influence processes of technological design, production and use. While Feenberg is foremostly read as a critical theorist, this essay argues that his call to democratize technology stands on distinct phenomenological grounds. This is based on the way he illustrates the role of experience in subtending potentials for the progressive transformation of the sociotechnical sphere. Against this background, this essay identifies an important shift in (...) the way Feenberg articulates experience, from relating it to lifelong processes of learning and identity-construction (Bildung) to an emphasis on visceral immediacy (Erlebnis). This shift manifests a newfound focus on material, embodied meanings over-against linguistic ones, and results in a considerable tension between Feenberg’s appeal to experiential self-evidence and his critical position toward technology. The discussion of the two modes of experience exemplifies the current that underlies Feenberg’s work, namely the creation of traffic between ontological and ontic accounts of sociotechnical entities, practices and relations.
